Nevada Revised Statute 200.468 prohibits human trafficking of illegal aliens with the intent either to subject the victims to involuntary servitude or to commit a felony crime or to violate labor laws. A category B felony, human trafficking for illegal purposes carries one to 20 years in prison and a possible $50,000 fine.
The full text of the statute reads as follows:
NRS 200.468. 1. A person shall not transport, procure transportation for or assist in the transportation of or procurement of transportation for another person into the State of Nevada whom the person knows or has reason to know does not have the legal right to enter or remain in the United States with the intent to:
(a) Subject the person to involuntary servitude or any other act prohibited pursuant to NRS 200.463, 200.4631 or 200.465;
(b) Violate any state or federal labor law, including, without limitation, 8 U.S.C. § 1324a; or
(c) Commit any other crime which is punishable by not less than 1 year imprisonment in the state prison.2. A person who violates the provisions of subsection 1 is guilty of trafficking in persons for illegal purposes and shall be punished for a category B felony by imprisonment in the state prison for a minimum term of not less than 1 year and a maximum term of not more than 20 years, and may be further punished by a fine of not more than $50,000.
Legal Analysis
NRS 200.468 makes it a crime to transport a person with the knowledge he/she had no legal right to be in the U.S., and the transporter has the intent to either:
- make the person a slave (involuntary servitude); or
- violate any state or federal labor law; or
- commit any felony crime1
A key element in NRS 200.468 cases is that the defendant has intent to break the law.2 Typical evidence in these cases includes the victim’s testimony, eyewitness accounts, recorded communications, and/or surveillance video.
Human trafficking with the intent to subject the victim to involuntary servitude or to commit any other felony is a category B felony in Nevada. It is punishable by one to 20 years in state prison as well as a potential fine of $50,000.3
